This policy complies with Directive 2011/83/EU on consumer rights and Articles 52-59 of the Consumer Code (Legislative Decree 206/2005).

Right of Withdrawal (Article 9, Directive 2011/83/EU)

In accordance with Article 9 of Directive 2011/83/EU, you have the right to withdraw from the purchase contract without providing any reason within 14 days from the moment you or a third party designated by you (other than the carrier) physically takes possession of the goods.

Exclusions from the Right of Withdrawal (Article 16, Directive 2011/83/EU)

According to Article 16 of Directive 2011/83/EU, the right of withdrawal does not apply to certain categories of goods. In particular, the following are excluded from the right of withdrawal:

Perishable goods or goods that may deteriorate rapidly (such as plants, flowers, and other botanical products).

Products custom-made or clearly personalized at the customer's request.

Sealed goods that cannot be returned for hygiene reasons if the seal has been removed after delivery.

Withdrawal Procedure for Eligible Goods

If you have purchased a product that does not fall under the exclusions listed above, you can exercise your right of withdrawal by following the procedure below.

1. Notification of Withdrawal (Article 11, Directive 2011/83/EU)

To exercise your right of withdrawal, you must explicitly notify us of your decision. You can do this via a written statement (e.g., by email or registered letter), or by using the Standard Withdrawal Form provided by law, which you can download here [link to form].

The withdrawal notification must include:

The order number.

The customer's name and address.

The date of purchase and the date of receipt of the product.

An explicit statement of your wish to withdraw from the contract.

2. Return of Goods (Article 14, Directive 2011/83/EU)

Goods must be returned no later than 14 days from the date you notified us of your decision to withdraw. Products must be returned:

In intact condition, without signs of use.

In their original packaging, complete with accessories, manuals, and other components received with the product.

The cost of return shipping is borne by the customer, unless the return is due to an error on our part or a damaged product.

3. Refund (Article 13, Directive 2011/83/EU)

Once we have received the goods and verified that they comply with the conditions mentioned above, we will issue a refund within 14 days from the day we were informed of your decision to withdraw. The refund will include all payments made, including original shipping costs, excluding additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us.

The refund will be issued using the same payment method used for the initial transaction, unless otherwise agreed.

4. Warranty and Returns

Return Processing:

Once the return is received, Eurogarden S.A.S. commits to processing the request within 30 days from the date of receipt of the returned product. The refund or replacement will be processed within this period, except in cases of force majeure.

Return Shipping Costs

The shipping costs for returning goods are entirely borne by the customer (Article 14, Directive 2011/83/EU), unless the return is due to our error or a damaged product.

Condition of Returned Product (Article 14, Directive 2011/83/EU)

If returned goods are found to be damaged, used, or incomplete, a proportionate amount may be deducted from the refund to compensate for the diminished value, as provided for in Article 14 of Directive 2011/83/EU.

Exceptions to the Right of Withdrawal for Plants and Perishable Products (Article 16, Directive 2011/83/EU)

In accordance with Article 16 of Directive 2011/83/EU, goods that are liable to deteriorate rapidly, such as plants and other botanical products, are not subject to the right of withdrawal. However, we are committed to ensuring that our products are delivered to you in perfect condition.

If plants or other perishable products arrive damaged or not as described, we invite you to contact us within 24 hours of receipt to initiate a replacement or refund request. In such cases, we ask you to provide us with:

Photos of the damaged product.

Description of the problem encountered.

In case of an incorrect product (different from what was ordered), we will provide a replacement or a refund at no additional cost.

Special Conditions for Plant Returns

If a plant arrives damaged or not as described, you can contact us within 24 hours of arrival, and we will provide a replacement or a refund based on the conditions and availability. However, we cannot accept returns if the damage to the plant was caused by improper care or unsuitable environmental conditions after delivery.
